Please read these Terms of Service ("Terms") carefully before using ListingEnhancer.com (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Service Description

ListingEnhancer.com provides AI-powered real estate photo enhancement services, including but not limited to:

• Virtual furniture staging for empty rooms
• Furniture removal from existing rooms
• Landscaping and outdoor space enhancement
• General image quality improvement
• Combined enhancement processing

Our Service is designed for real estate professionals and property owners seeking to improve the visual presentation of real estate listings.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Use the Service solely for lawful purposes
• Provide accurate, complete, and current account information
• Have the legal authority to agree to these Terms on behalf of yourself or the organization you represent

By using the Service, you represent and warrant that you meet all of the foregoing eligibility requirements.

3. Account Registration

To access certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials, including your password. You are solely responsible for all activity that occurs under your account, whether or not authorized by you.

You agree to notify us immediately at legal@listingenhancer.com of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this obligation.

4. Credits, Payments & Refunds

Access to enhanced photo downloads requires the purchase of credits. The following terms apply to all credit purchases and payments:

• Credit Consumption: Credits are consumed when you download your final enhanced photos. Viewing watermarked previews does not consume credits.
• Non-Refundable Credits: Credits are non-refundable once they have been applied to a photo download.
• Credit Expiration: Unused credits expire 12 months after the date of purchase.
• Payment Processing: All payments are processed securely through Stripe. We do not store your full payment card details on our servers.
• Pricing: Credit package prices are listed on our pricing page and are subject to change with reasonable notice.

5. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate enhanced versions of your photos. You acknowledge and agree that:

• Results may vary depending on the quality, composition, and content of the original photos you submit.
• AI enhancements are computer-generated and may not perfectly match your expectations, style preferences, or specific staging requirements.
• We make no warranty that enhanced photos will be suitable for any particular purpose.

Free Re-Process: If you are unsatisfied with an AI-enhanced result, we offer one free re-process per photo. This free re-process must be requested before credits are consumed for that photo. After credits have been consumed, no re-process or refund will be provided.

6. User-Uploaded Content

Ownership: You retain full ownership of all photos and content you upload to the Service. We claim no ownership rights over your uploaded content.

License Grant: By uploading photos to the Service, you grant ListingEnhancer.com a limited, non-exclusive, royalty-free license to process, store, and use your photos solely for the purpose of providing you with photo enhancement services. This license terminates when your content is deleted from our systems.

Privacy: We do not sell, share, license, or otherwise distribute your uploaded photos to any third parties.

Data Retention: We will delete your original uploaded photos and their enhanced versions 90 days after your processing session. You are responsible for downloading your final enhanced photos before this retention period expires.

Your Representations: By uploading content, you represent and warrant that you own or have all necessary rights to the photos you upload and that your use of the Service does not infringe any third-party intellectual property rights.

7. Acceptable Use

You agree not to use the Service to:

• Upload, transmit, or process any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload photos or content for which you do not hold the necessary rights, licenses, or permissions
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of our AI models or proprietary technology
• Use automated scripts, bots, scrapers, or other automated means to access, scrape, or collect data from the Service
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• Circumvent or attempt to circumvent any security features or access controls of the Service
• Use the Service for any fraudulent, misleading, or deceptive purpose

We reserve the right to suspend or terminate your account and access to the Service if you violate any of these acceptable use provisions.

8. Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, ListingEnhancer.com and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

Liability Cap: In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the total amount you have paid to ListingEnhancer.com in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless ListingEnhancer.com and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights or privacy rights
• Any content you upload, submit, or transmit through the Service

10. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in California for the resolution of any disputes arising out of these Terms or your use of the Service.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes to these Terms, we will notify registered users via email at least 30 days before the changes take effect. Non-material changes may be posted on this page with an updated effective date.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date of the changes.

12. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at legal@listingenhancer.com. Termination does not entitle you to a refund of any unused credits except as required by applicable law.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ListingEnhancer.com with respect to your use of the Service and supersede all prior agreements, understandings, and communications relating to the Service.
